(a)Privileged mail.

Any item of correspondence to or from those persons (titles) or entities listed below:

(1)any United States or New York State Government Official;
(2)any member of the United States Congress;
(3)any member of the New York State Legislature;
(4)any Judge of any Federal or New York State Court;

Note:

This does not include Town Justice Court.

(5)the resident's attorney of record or legal representative (law guardian);
(6)the commissioner of the New York State Office of Children and Family Services;
(7)any deputy commissioner of the New York State Office of Children and Family Services; and
(8)an ombudsman of the New York State Office of Children and Family Services.
(b)Government official.

The following individuals shall be considered to be government officials:

(1)President or Vice President of the United States;
(2)a member of the U.S. Cabinet;
(3)commissioner, chief, sheriff of a police department;
(4)commissioner of a State agency;
(5)a deputy commissioner of a State agency; and
(6)a district attorney or a representative of an assistant district attorney.
