(a)The facility or program director shall immediately notify the office of the ombudsman of any critical incident involving a youth under his/her care.
(b)For the purpose of this Part, a critical incident shall mean:
(1)an incident which indicates that a violation of rights has occurred that could lead to disciplinary action and/or criminal prosecution;
(2)an incident in which a youth has died or sustained substantial physical injury; or
(3)an incident which could give rise to a claim against a youth.
