9 NYCRR 98.1 - Declaratory rulings

Any person may apply to the Authority for a declaratory ruling with respect to the applicability to any person, property or state of facts of any rule or statute enforceable by the Authority.

Petitions for declaratory rulings shall:

(a)Contain a statement that a declaratory ruling is requested.

(b)Include a short concise statement of the state of facts or uncertainty with respect to which a declaratory ruling is required, including a full disclosure of the petitioner's interest.

(c)Be addressed to Counsel, State Liquor Authority, Two World Trade Center, New York, New York 10047.

No opinion, letter of advice, or other communication by the Authority shall be deemed a declaratory ruling unless it contains a statement that it is a declaratory ruling or is issued in response to a petition which complies with all of the conditions of section 98.2 of this Part.
