No licensee shall sell, offer for sale, agree to sell or deliver in this State, to a retail licensee holding a license pursuant to section 63 or 64 of the Alcoholic Beverage Control Law, any liquor described and identified by warehouse receipts unless such licensee is the holder of a license pursuant to section 61 or 62 of the Alcoholic Beverage Control Law, except as hereinafter provided.

No letterhead, order blank, invoice, sales slip, bill, contract, receipt, certificate or document relating in any way to liquor stored in a warehouse, shall be used by any licensee holding a license pursuant to section 61 or 62 of the Alcoholic Beverage Control Law, or any person holding a permit pursuant to section 93 of the Alcoholic Beverage Control Law, in connection with the solicitation, sale or delivery of liquor to a retail licensee holding a license pursuant to section 63 or 64 of the Alcoholic Beverage Control Law, in this State, described and identified by warehouse receipts, unless and until a specimen of such letterhead, order blank, invoice, sales slip, bill, contract, receipt, certificate or document relating in any way to liquor stored in a warehouse shall have been submitted to the State Liquor Authority with a written request for approval and written approval by the authority obtained.

Liquor and wine may be sold to retailers only in sealed containers as provided by law. Therefore, manufacturers and wholesalers may sell to retailers, liquor and wine described and identified by warehouse receipts, only if such liquor or wine is contracted to be sold in sealed containers as provided by law. Retailers may not sell any liquor or wine described and identified by warehouse receipts.

A violation of any of the above provisions shall be deemed cause for the revocation, cancellation or suspension of the license or permit held by the persons involved.
