(a)The provisions of this Part shall apply to the funding of programs providing services to eligible witnesses and to families of eligible witnesses to the extent appropriate to achieve or maintain their security.
(b)Funds available for disbursement pursuant to this Part shall include those funds appropriated by the State Legislature and funds received by the State from any public or private agency or person, including the Federal government for the purposes of crime witness protection program services.

(a)Eligible witness.

A victim of or a witness to a crime who has the need for witness protection program services.

(b)Family of eligible witness.

Any person related to such person within the third degree of consanguinity or affinity; any person maintaining a sexual relationship with such person; or any person residing in the same household with such person.

(c)Provider agency.

A partnership, corporation, association, municipality, governmental agency, public or private organization of any character, including but not limited to a police agency, the office of district attorney, or a victim-witness assistance program, who provides one or more program services as defined by this Part.

(d)Program services.

Those services necessary for the prevention of intimidation and the protection of an eligible witness which may include, but shall not be limited to: temporary relocation, changes in employment, transportation to and from court, moving assistance, personal protection services, temporary lodging and support services. Program services shall also mean services provided to the family of an eligible witness where and to the extent appropriate to achieve or maintain their security. The provider agencies shall consider, among other factors, whether providing witness protection program services is likely to ensure the availability of victims or witnesses to provide information to law enforcement in the investigation and/or prosecution of the relevant crime or crimes.

(a)A provider agency seeking funding pursuant to this Part shall prepare an application on the form prescribed by the commissioner of the Division of Criminal Justice Services. An original and four copies shall be submitted to the contracts unit of the Division of Criminal Justice Services. All applications must have the signed approval of the county executive or his equivalent and be submitted through the criminal justice planner of the county or region. If the county does not have such a planner, it must be submitted through the county executive or an equivalent office. District attorneys may submit applications directly to the Division of Criminal Justice Services upon notification thereof to their respective county executives or criminal justice planners. Only those applications which are totally completed will be considered for funding.
(b)Preference.

Preference will be given to victim service agencies that provide those services, including but not limited to temporary relocation, changes in employment, transportation to and from court, moving assistance, temporary lodging and support services necessary for the prevention of intimidation and protection of eligible witnesses.

(c)Nonsupplantation.

Funds provided to successful applicants under this program shall be used to augment, not to supplant, applicant's current funding for victim assistance or witness protection services.

(a)The commissioner of the Division of Criminal Justice Services in consultation with the Crime Victims Board shall select programs for funding pursuant to this Part and shall determine the amount of funds to be disbursed for each program within available appropriations.
(b)In addition to the preference pursuant to section 6171.3(b) of this Part, the selection process shall require, but not be limited to, consideration of these factors:
(1)the need for the program in the geographical area served or to be served;
(2)the availability of other sources of funding;
(3)whether such program is likely to ensure the availability of victims or witnesses to provide information to law enforcement in the investigation and/or prosecution of relevant crime or crimes;
(4)the established cooperation and coordination with the components of the criminal justice system (i.e., police, district attorneys, courts, etc.);
(5)the established cooperation and coordination with other service providers within the service area;
(6)how the nature of the services to be rendered will enhance existing witness protection efforts;
(7)the nature of the services to be rendered, the target population to be served by such services, and the cost associated with rendering such services;
(8)the ability of applicant to administer the program;
(9)the qualifications and relevant experience of personnel administering the program (e.g., board of directors), and the personnel staffing the program;
(10)the adequacy and costs of program facilities; and
(11)established fiscal controls which guarantee the proper handling and recording of program funds.

(a)The Division of Criminal Justice Services shall monitor and evaluate the effectiveness of each program receiving funds pursuant to this Part.
(b)Each grant recipient shall provide to the Division of Criminal Justice Services a quarterly report which must contain certain, but not be limited to the following, information concerning its program:
(1)total service requests received;
(2)aggregate statistics containing nonidentifying information regarding the number of eligible witnesses served, and basic demographic information (e.g., age, sex, ethnicity);
(3)referrals to other agencies;
(4)the nature of the cases for which services were provided and the outcome of the prosecution of such cases;
(5)the types and costs of the services provided and the justification for the specific services selected;
(6)the amount of and purpose for which monies were expended;
(7)a description of how the assistance provided enhanced witness protection services;
(8)any information from the eligible witnesses serviced, the police, victim-witness assistance programs or the district attorney concerning the value of the services rendered and suggestions for further improvements; and
(9)any other information as required by the commissioner of the Division of Criminal Justice Services.
(c)The Division of Criminal Justice Services shall have the right and authority to inspect at any time the operation of any program receiving funds pursuant to this Part. Such inspection may include, but is not limited to, the fiscal books and records of the program, equipment inventory, personnel time records, and any other nonconfidential records that the commissioner deems appropriate.

(a)Eligible witness information.

Information, files and records created pursuant to this Part in the possession of provider agencies and related solely to service provided by such agency are confidential and may not be disclosed by any person. Such information, files and records are not subject to disclosure in any judicial or administrative proceeding unless the court in which the criminal proceeding is pending or was disposed of, upon notice to the district attorney and an opportunity to be heard, determines that such disclosure would not endanger the health, welfare or safety of the witness or the family of the witness and is compelled by the interests of justice.

(b)Funding prohibition.
(1)No funds awarded pursuant to this Part shall be used to purchase firearms or other deadly weapons. No authorization exists under this Part for the possession, carrying, utilization, dissemination or acquisition of firearms or other deadly weapons.
(2)No funds awarded pursuant to this Part may be used on private guard services, including salaries, fees or expenses incurred for hiring of or for use of private guards. No funds may be used to purchase guard dogs or guard dog services.
(3)No funds awarded pursuant to this Part may be used to pay for the preparation of project proposals.

Nothing contained in this Part shall impose liability upon the commissioner of the Division of Criminal Justice Services, the Crime Victims Board or the State for death, injury or loss incurred by eligible witnesses or their families while such persons are receiving program service through the witness protection program.
