Applicability.

The provisions of this Part shall apply to all lottery games. In the event any rule or regulation or a particular lottery game substantially duplicates or is inconsistent with this Part, this Part shall control.

Validation conditions.

(a)A ticket matching all game play and validation data recorded in the commission’s central gaming system shall be the only valid proof of the play and only valid mechanism for claiming or redeeming any prize. If, for any reason, a ticket is not entirely legible or is misprinted or altered in any way, then the computer record on the central gaming system shall be the sole method of determining whether such ticket is a valid ticket. Neither the commission nor the commission’s contractors shall be responsible for tickets inadvertently returned to a purchaser following redemption or cancellation by a lottery sales agent. In such cases, the computer file shall be the sole method for determining whether the ticket has been redeemed or cancelled. In addition to the general requirements of this section, ticket validation requirements for instant-game tickets are set forth in section 5006.8 of this Title.

(b)In order to be deemed a valid and winning lottery ticket all of the following conditions must be met, as the commission may determine in the commission’s discretion:

(1)the validation data must be present in its entirety and must correspond, using the computer validation file on the central gaming system, to:

(i)number selections, draw date(s), ticket serial number, ticket security code, and ticket stock serial number printed on the ticket, in the case of a draw-game bet ticket; and;

(ii)validation barcode and ticket identifying barcode and associated numbers printed on the ticket, in the case of an instant ticket;

(2)the ticket must be intact;

(3)the ticket must not be mutilated, altered, reconstituted, or tampered with in any manner;

(4)the ticket must not be counterfeit or an exact duplicate of another winning ticket;

(5)the ticket must have been issued by the commission or a lottery sales agent in an authorized manner;

(6)the commission must not have actual knowledge that the ticket has been stolen;

(7)the ticket must be submitted for payment in accordance with the commission’s procedures for claiming and payment of a prize;

(8)for a draw-game bet ticket, the ticket data must have been recorded on the commission’s central gaming system prior to the drawing and the ticket data must match this computer record in every respect. In the event of a contradiction between information as printed on the ticket and as accepted by the commission’s central gaming system, the play accepted by the commission’s central gaming system shall be the valid play;

(9)a ticket with that exact validation data must not have been previously paid as recorded on the central gaming system;

(10)the ticket must not be mis-registered, defectively printed, or produced in error to an extent that such ticket cannot be processed by the commission;

(11)the bet ticket for a multi-jurisdictional lottery game must pass any validation test required in connection with such multi-jurisdictional game;

(12)there must not be any other breach of the game rules or regulations in relation to the ticket that, in the discretion of the commission, justifies invalidation;

(13)no bet ticket for a multi-jurisdictional lottery game purchased outside the State of New York shall be paid by either the commission or lottery sales agent; and

(14)the ticket must pass all additional confidential and security validation tests of the commission.

Void ticket.

Any ticket that does not conform to the requirements of this Part, including, without limitation, any validation conditions, shall be void and may not be paid, as determined by the commission. The commission may, at the commission’s sole discretion, replace a void ticket with a ticket for a future drawing in such game or an equivalent one in sales price from any other game.
