Civilian positions in the service of the New York State Police shall be filled pursuant to section 6 of article 5 of the Constitution of the State of New York, so far as practicable, after competitive examination.

By virtue of the character of their duties and/or the nature of the relationship that they bear to the superintendent, it is impracticable to hold competitive examinations for the following positions that shall be filled after a noncompetitive process, except where in the judgment of the superintendent, qualified members should be assigned to the position of Supervisor of State Police Public Relations, or to the positions of Director of Personnel, Assistant Director of Personnel State Police, Director of State Police Communications, Assistant Director of State Police Communications, and Director of State Police Employee Assistance Program or to the positions in the State Police Laboratory, including the position of Director of State Police Laboratory:
