This Part relates to the funding of drug elimination programs pursuant to the Public Housing Drug Elimination Pilot Program, article XII, Public Housing Law, as added by chapter 713 of the Laws of 1990. The applicability of this Part is conditioned on receipt of funding by the division and the division's publication of a notice of funding availability.

(a)controlled substance shall have the same meaning given such term in section 3306 of the Public Health Law; and
(b)drug-related crime shall mean the illegal manufacture, sale, distribution, use, or possession with intent to manufacture, sell, distribute, or use, a controlled substance.

An authority may use a grant under this Part for:

(a)innovative drug elimination programs to reduce the use of drugs in and around public housing projects;
(b)funding assistance to nonprofit public housing resident management corporations and tenant councils to develop security and drug abuse prevention programs involving site residents;
(c)physical improvements in public housing projects which are specifically designed to enhance security;
(d)training, communication equipment, and other related equipment for use by voluntary public housing tenant patrols acting in cooperation with local law enforcement officials;
(e)the employment of security personnel in public housing projects;
(f)the reimbursement of local law enforcement agencies for additional security and protective services for public housing projects; and
(g)the employment of one or more individuals:
(1)to investigate drug-related crime on or about the real property comprising any public housing project; and
(2)to provide evidence relating to any such crime in any administrative or judicial proceeding.

(a)To apply for a grant under this Part, an authority shall submit an application to the division at such time and in such manner as the division may reasonably require in a notice of funding availability. Such application shall include all information as may be required by the division as well as a plan for addressing the problem of drug-related crime on the premises of the public housing project(s) administered by the authority.
(b)The division shall evaluate and select programs for funding under this Part based upon a scoring system which will include but not be limited to the following criteria:
(1)the extent of the drug-related crime problem in the building(s) and grounds of the public housing project;
(2)the quality of the plan of the authority to address drug-related crime in the public housing project(s);
(3)the capability of the authority to carry out the plan;
(4)the anticipated cost-effectiveness of the plan;
(5)the absence of funding available from other sources sufficient to carry out such plan; and
(6)the extent to which the local government and local community support the anti-drug activities of the housing authority.
(c)The division shall notify those authorities which have been awarded grants pursuant to this Part. All such awards are to be contingent upon the execution of a contract between the division and the housing authority upon such terms and conditions as the division may prescribe.
