Authorities are required to manage buildings on site and offsite property from time of acquisition until the time such buildings are demolished. The first step in such management is to make a survey of the tenants, both residential and commercial, in possession, as well as a physical inspection of buildings and equipment.

(a)The tenant survey should ascertain, for each tenant, his name and address, present rent, family composition, total family income, citizenship, plans for relocation, any adverse health conditions existing in family, as well as any other data considered necessary in relocating tenants.
(b)The survey of buildings and equipment should include janitorial services furnished, if any, layout plans if possible, number of apartments broken down by size, heating system, type of utilities, health hazards and need for immediate action with respect to those hazards, existing insurance coverages and other similar data. The condition of the buildings in general and of each apartment, including the fixtures and other equipment, will be noted. A copy of this building and equipment inventory will be forwarded to the Bureau of Management.

(a)Applications for public housing shall be processed for all site (or offsite) tenants interested in public housing. In accordance with section 17 of the Public Housing Law, these tenants have the highest priority for assignment, provided they are otherwise eligible for public housing. Section 153 of the Public Housing Law, under certain circumstances, allows higher income levels for determining eligibility of such tenants.
(b)In cases of site and offsite tenants who are not interested in public housing, a signed statement to that effect shall be obtained. This statement does not nullify the tenant's assignment priority in the event he should change his mind later, but it is a basis for the authority to proceed in assignment of apartments to eligible applicants in the next priority category.
(c)Eligibility of site and offsite tenants can generally be ascertained prior to the project's apartments being ready for occupancy. However, if all apartments are ready for occupancy before offsite property is acquired, or if there are delays in determining eligibility which are not attributable to site or offsite tenants, the Bureau of Management should be advised so that plans for accommodating such possible eligible families can be formulated.

(a)Rents shall be the same as those paid to previous owners. Verification of such rents can be made by checking rent receipts, cancelled checks, and obtaining information from previous landlord. If previous rents are considered inequitable, either to tenant or to authority (as may occur when tenant is a relative of previous landlord), or if there was no previous rent established, as in the case of owner-occupied home, the authority shall establish equitable rents subject to division approval.
(b)Rents should not include utilities such as heat, gas and electricity, unless conditions such as a central heating system or a single meter necessitate their inclusion.

No lease agreement will normally be entered into, with tenancy being on a month-to-month basis. Under special circumstances, however, an authority may enter into a lease agreement with commercial tenants. Approval by the division is required. The term of such lease must not extend beyond anticipated demolition date, with the right of the authority to cancel on 30-day notice.

(a)The authority is entitled to rent from date of acquisition. This includes former owners as well as regular tenants. Rents tendered covering any period prior to date of acquisition shall not be accepted.
(b)If tenant has paid rent to former owner for period beyond date of acquisition, authority's counsel should be advised of amount so that claim for amount can be made on former owner and deducted from purchase payment. However no action should be taken without verification through rent receipt or cancelled check.
(c)Rents are to be paid on the first of each month. Legal steps for eviction should be scheduled so that eviction, if necessary, can take place in the same month in which tenant became delinquent. Dilligent efforts will be made to collect from any site or offsite tenant who vacates owing rent or other charges. Judgments and garnishees will be sought where indicated.
(d)No security deposits are required from residential tenants occupying site and offsite apartments, but the authority may require such deposit in case of a commercial tenant.
(e)Site and offsite tenants eligible for admission to project must pay all arrears of rent or other charges before they are admitted to project.

(a)Maintenance of buildings on site and offsite property will be kept at a minimum consistent with the safety of the occupants. Buildings declared unsafe by local building department will be vacated immediately with the authority's counsel initiating any necessary legal action. No major repairs will be made to any site or offsite building unless approved by the division.
(b)Determination should be made as to whether fixtures and equipment (plumbing and heating items, refrigerators, ranges, etc.) can be properly safeguarded if left in apartments or whether they should be removed immediately from each apartment as it becomes vacant and placed in a central storage room. If it is determined to let such equipment remain in apartments, demolition contract will specify that such items will be removed by contractor. If equipment is removed from individual apartments and centrally stored, they will be accumulated in sufficient quantity and then sold on basis of best bid received. Bids will be solicited from used equipment dealers and salvage yards. Vacated apartments should be checked as soon as possible to insure that authority owned fixtures and equipment were not taken by the vacated tenant. Vacated buildings are to be boarded up and the police department notified so that they can take steps to prevent damage by vandals or entry by vagrants. An authority employee should also check such buildings at least once a week.
(c)Preparation for demolition, including award of contract, should be made in advance so that demolition can start as early as possible after buildings are vacated. If situation warrants, contract may call for demolition of buildings on an individual basis as they become vacant.

The insurance carrier is to be notified prior to the acquisition of any building so that coverage, as required by Part 1630 of this Subchapter, may be obtained. The Bureau of Management is to be notified immediately of any accident or fire. Fatal or serious personal injuries or extensive property damage will be reported by telephone or telegram. Demolition of buildings and disposition of offsite property should be accomplished as soon as possible so that the authority is relieved of this extra responsibility and that any expenses in connection with the offsite property, including real estate taxes, can be eliminated. Reduction in real estate taxes, if applicable, should be obtained when a building has been demolished.

In connection with any project, the authority shall prepare lists of suitable apartments available from private sources and maintain contact with local real estate brokers so that site and offsite tenants not interested in public housing can be referred to such available housing. Publicity in local newspapers requesting suitable apartments for families to be relocated and classified advertisements offering apartments for rent should be utilized in preparing such lists.

An authority may pay removal costs, i.e., moving expenses and one month's rent, of low income families from area or buildings to be cleared to suitable locations, in such amounts as may be approved by the commissioner, but in no event more than $200 per family. Commercial tenants may also be allowed such costs if approved by the commissioner, up to a maximum of $500. Such payments will be made by check payable to the tenant only. Any arrears owed to the authority by the tenant will be deducted prior to issuing the check.

The authority's counsel shall undertake such legal steps as are deemed necessary to effect the vacating of site and offsite property by the scheduled demolition date. Legal action should be started where there is the slightest doubt that the tenant will be able to relocate by the scheduled date. However, actual eviction should be effected only as a last resort, usually in the case of obdurate and non-cooperative tenants.

Close coordination should be maintained with the construction advisor so that as much advance information as possible is obtained concerning the anticipated date of initial occupancy. Certain items must be completed by the authority before initial occupancy can take place. Following is a check list of the most urgent of these items; it is to serve as a guide and should not be considered as all inclusive. The Division of Housing will extend every possible assistance when called upon but the basic responsibility for the accomplishment of these items rests with the local authority and its employees.

(a)Preparation of rent schedules for approval by division. See Part 1627, infra.
(b)Selection of tenants in accordance with tenant selection procedures as outlined in Parts 1626 and 1627.
(c)Determination of staff requirements for approval by the division. It is recommended that staffing patterns for similar projects located in other cities or nearby communities be studied. Additional assistance may be obtained directly from the division.
(d)Employment of personnel to fill staff positions approved by the division, in accordance with local civil service commission procedures.
(e)Arrangements for telephone services for project offices and for public pay stations if considered necessary.
(f)Procurement of necessary insurance coverage in accordance with provisions of Part 1630, infra.
(g)Arrangements for mimeographing or printing services for tenant selection forms, leases, internal operating forms, etc. Sample standard forms are available from the division for local reproduction.
(h)Solicitation of bids for fuel oil if needed for space heating and hot water heating services. Solicitation will be on standard fuel oil contract documents. See Part 1628, infra.
(i)Arrangements with local utility companies for needed services.

Different rate classifications should be reviewed with utility representatives and the most favorable classification sought.

(j)Preparation of necessary equipment list.

A list of office and shop equipment, motor vehicles, tools and supplies, etc. needed for the initial operation of the project must be submitted to the division for approval. Assistance in preparation of this initial equipment list is available from the Bureau of Management upon request.

(k)Establishment of a purchasing procedure in accordance with Part 1628 of this Subchapter.
(l)Preparation of a tenant handbook for division approval prior to printing. Copies of handbooks issued by other housing authorities should be obtained for guidance.
(m)Solicitation of contracts for concession of coin-operated laundry equipment, if deemed necessary.
(n)Coordination of trash and garbage removal with municipal department furnishing such service. If not furnished by municipality, arrangements should be made to contract for such services. Garbage cans should be furnished for centrally located garbage stations. The quantity of cans needed will vary with the frequency of collection but estimates of need can be based on one 26 gallon can per family with a collection frequency of three times per week.
(o)Preparation for outside clothes drying areas.
(p)Inspection of fire alarm system and hydrants by local fire department.
(q)Establishment of procedures covering emergency situations arising during non-working hours.
(r)Establishment of bank accounts as required by Subchapter D of this Chapter (§ 1646-6.2, subds. [c] and [d]).
(s)Establishment of a key control system.

At least one extra set of keys should be maintained for each apartment. Note that last key should never be given to tenant but used as sample to cut additional keys.

(t)Preparation of work schedules for all employees.
(u)Coordination of mail deliveries and street addresses with local post office.

A plan of project streets and addresses should also be given to police and fire departments, local hospitals, local medical associations, local churches, local pharmacies, and to any other group or individual that may have occasion to respond to an emergency call.

(v)Physical inspection of project by authority personnel.

Responsible authority personnel should make physical inspections of the apartments, heating plant, etc. during construction to familiarize themselves with shut-off controls of utilities and heating, house sewer clean-outs, fuse boxes and similar items. Architect and contractor representatives will render valuable assistance in this matter.
